Indiana Firework Laws

 

IC 22-11-14-6 Violations; offenses; time and dates of allowable usage of consumer fireworks.  Make sure you check your local county or municipality for laws that may be more restrictive than what is provided under Indiana Law. 

 

Where can you light fireworks- violation is a class C infraction

  • property of another who has given you permission
  • special discharge location

Who can light fireworks? violation is a class C infraction

  • Adults over the age of 18
  • Minors if an adult is present

When can you light fireworks? violation is a class C Infraction

  • 9:00 am – 11:00 pm everyday
  • 9:00 am – midnight on holidays including December 31st.New Year’s Day, January 1.Martin Luther King, Jr.’s Birthday, the third Monday in January.Abraham Lincoln’s Birthday, February 12.George Washington’s Birthday, the third Monday in February.Good Friday, a movable feast day.Memorial Day, the last Monday in May.

    Independence Day, July 4.

    Labor Day, the first Monday in September.

    Columbus Day, the second Monday in October.

    Election Day, the day of any general, municipal, or primary election.

    Veterans Day, November 11.

    Thanksgiving Day, the fourth Thursday in November.

    Christmas Day, December 25.

 

Elevated offenses

(e) A person who recklessly, knowingly, or intentionally uses consumer fireworks and the violation causes harm to the property of a person commits a Class A misdemeanor.

(f) A person who recklessly, knowingly, or intentionally uses consumer fireworks and the violation results in serious bodily injury to a person commits a Level 6 felony.

(g) A person who recklessly, knowingly, or intentionally uses consumer fireworks and the violation results in the death of a person commits a Level 5 felony.

(h) A person who knowingly or intentionally fails to collect or remit to the state the public safety fees due under section 12 of this chapter commits a Level 6 felony.

Indianapolis Firework Laws

Sec. 407-201. – Consumer fireworks—Using, igniting and discharging limited.

(a) It shall be unlawful for any person to use, ignite, or discharge any consumer fireworks, as defined in IC 22-11-14, at any place in the consolidated city, except during the following times:

(1)On June 28, between the hours of 5:00 p.m. and two (2) hours after sunset;

(2)On June 29, between the hours of 5:00 p.m. and two (2) hours after sunset;

(3)On June 30, between the hours of 5:00 p.m. and two (2) hours after sunset;

(4)On July 1, between the hours of 5:00 p.m. and two (2) hours after sunset;

(5)On July 2, between the hours of 5:00 p.m. and two (2) hours after sunset;

(6)On July 3, between the hours of 5:00 p.m. and two (2) hours after sunset;

(7)On July 4, between the hours of 10:00 a.m.. and 12:00 midnight;

(8)On July 5, between the hours of 5:00 p.m. and two (2) hours after sunset;

(9)On July 6, between the hours of 5:00 p.m. and two (2) hours after sunset;

(10)On July 7, between the hours of 5:00 p.m. and two (2) hours after sunset;

(11)On July 8, between the hours of 5:00 p.m. and two (2) hours after sunset;

(12)On July 9, between the hours of 5:00 p.m. and two (2) hours after sunset; and

(13)On December 31 and January 1, between the hours of 10:00 a.m. on December 31 and 1:00 a.m. January 1.

(b)Violations of this section are subject to the following enforcement provisions:

(1)For this first offense in any twelve month period, shall be subject to admission of violation and payment of the civil penalty in accordance with Chapter 103;

(2)For the second offense in any twelve month period, the civil penalty is fixed at a minimum of five hundred dollars ($500.00) under the provisions of section 103-3 of this Code; and

(3)For the third and subsequent offenses in any twelve month period, a civil penalty of up to two thousand five hundred dollars ($2,500.00) shall be imposed under the provisions of section 103-3 of this Code.

Westfield Firework Laws

The City of Westfield bans all use of fireworks at all times and locations with the exception of the
following dates and times:
(A) Between the hours of 5:00 p.m. and two (2) hours after
sunset on June 29, June 30, July 1, July 2, July 3, July 5,
July 6, July 7, July 8, and July 9;
(B) Between the hours of 10:00 a.m. and 12:00 midnight on
July 4; and
(C) Between the hours of 10:00 a.m. on December 31 and 1:00
a.m. on January 1.
(D) Any other time and location duly authorized by the City of
Westfield by permit to be obtained prior to the scheduled
event.

Noblesville Firework Laws

City of Noblesville’s fireworks ordinance now states that consumer fireworks may only be used in the Noblesville city limits during the following days and times:

Between the hours of 5 pm and two hours after sunset on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8, and July 9.
Between the hours of 10 am and 12 midnight on July 4
Between the hours of 10 am on December 31 and 1 am on January 1.

Fishers Firework Laws

It shall be unlawful to use or display or permit to be used or displayed within Fishers’ municipal boundaries any type of consumer firework on any day or time other than the following:
(A) Between the hours of 5:00 p.m. and two hours after sunset on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8, and July 9;
(B) Between the hours of 10:00 a.m. and 12:00 midnight on July 4; and
(C) Between the hours of 10:00 a.m. on December 31 and 1:00 a.m. on January 1.
